- Regulatory Compliance Counsel
Description
The Regulatory Compliance Counsel contributes as a member of the fast-paced and fully integrated Vistra Regulatory & Compliance team for wholesale trading and commercial businesses, working in cross-functional teams, including Vistra legal, compliance, commercial, risk management, development, and regulatory affairs to provide legal and compliance guidance to business units. They research and provide analysis necessary to design, implement, and maintain compliance controls and lead discovery efforts and case management in responding to regulator inquiries. Additionally, they advocate the interests of the business units of Vistra before federal and state regulators, such as FERC, CFTC, PUCT, and the RTO/ISOs and advise the business on regulatory requirements and risks for new project development.
Key Accountabilities:
- Applies policy and regulatory expertise to anticipate and resolve issues in partnership with internal business clients.
- Builds strong working relationships with and manages outside counsel effectively and efficiently.
- Defends the company and advocates for the company’s interests in regulatory and enforcement actions.
- Provides advice and counsel on interconnection agreements, commercial agreements, and related issues supporting new resource development opportunities across the Vistra fleet.
- Provides compliance coverage under Federal Energy Regulatory Commission, Commodities Future Trading Commission, Public Utility Commission of Texas, and Regional Transmission Organization (RTO) rules for Vistra commercial business units, including designing, implementing, and maintaining compliance controls consistent with those rules.
- Provides legal research and analysis necessary to support commercial business units’ compliance in wholesale electricity and natural gas markets.
- Makes formal and informal contact with regulators, RTO staff, market monitor staff, and other market participants to gain better understanding of relevant rules and the overall regulatory environment.
- Actively monitors regulations, rules, and laws that affect the legal requirements and risk exposure of Vistra.
- Facilitates agreement across a wide range of disparate internal stakeholders.
Vistra Corp. observes a hybrid work schedule with Monday, Tuesday, and Thursday required in office days, and Wednesday/Friday as optional remote work days.
Requirements
J.D. required; must be licensed to practice law, preferably in Texas
Minimum 3 years’ of practice in energy regulatory law and/or policy or regulatory/administrative litigation practice
Strong analytical skills, judgment, energy/enthusiasm, and interpersonal skills
Excellent verbal and written communication skills
Skilled in use of Microsoft Office programs and ability to learn and use additional computer applications, as needed
